Työryhmän tavoitteena on ajantasaistaa julkisen hallinnon IT hankintaehdot erityisesti vastaamaan voimassa olevaa säädöspohjaa, suunnitella ja ehdottaa JIT-ehtojen ylläpito- ja hallintamallia sekä tiedottamista ja kirjata laajemmat muutostarpeet.

Goals and results

Työryhmän tehtävänä on:
- Toteuttaa tarvittavat muutokset JIT ehtoihin ja ehtojen liitteisiin
- Suunnitella ja ehdottaa JIT ehtojen ylläpito- ja hallintamalli
- Ehdottaa tarvittavien lisämuutosten ja uusien liitteiden valmistelu jatkotyötä varten
- Suunnitella ja ehdottaa JIT ehtojen julkaisu ja tiedottaminen

Starting points

JIT-ehtoja uudistettiin viimeksi vuonna 2018, ja ne ovat eräiltä osin sisällöllisesti vanhentuneet. JHS-järjestelmä lakkautettiin vuoden 2020 alussa tiedonhallintalain (906/2019) tultua voimaan, jolloin myös JIT-ehtojen (JHS 166) ylläpito päättyi. Vähimmäisvaatimuksena JIT-ehtoja uudistetaan vastaamaan voimassa olevaa säädöspohjaa, etenkin tiedonhallintalakia, tietosuoja-asetusta ja pakotelainsäädäntöä. Lisäksi EU-lainsäädäntö ja mm. pilvipalveluiden käyttö ovat tuoneet huomioitavia seikkoja sopimusehtojen uudistamistarpeeseen.

JIT-ehtoja päivitetään samanaikaisesti julkisissa hankinnoissa käytettävien yleisten ehtojen, ns. JYSE-ehtojen kanssa. Tavoitteena on, että työryhmän toimikautena tehdään JIT-ehtoihin kevyt päivitys siten, että uusia JIT-ehtoja voidaan julkaista vuoden 2025 alussa samanaikaisesti JYSE-ehtojen kanssa. Ajantasaiset JIT-ehdot ovat laajasti julkisen sektorin ja tietojärjestelmien toimittajien hyödynnettävissä.

Työryhmä arvioi JIT-ehtojen (JIT2015, päivitetty viimeksi 2018) uudistustarpeet. Tavoitteena on, että työryhmän työ etenee siten, että päivitetyt JIT-ehdot voidaan julkaista vuoden 2025 alussa. Mahdolliset laajemmat muutostarpeet toteutetaan myöhemmin. Tavoitteena on tuoda JIT-ehdot osaksi JYSE-ehtojen liitteitä, kuitenkin itsenäiseksi liitekokonaisuudeksi sekä mahdollisuuksien mukaan yhtenäistää JIT ehtojen käsitteistö JYSE-ehtojen kanssa.
